San Francisco’s Soft Story Ordinance and Your Claim

Mandatory Soft Story Retrofit Program, signed into law April 18, 2013

San Francisco requires a seismic retrofit of older wood frame apartment buildings with a soft story condition. The city’s program page says a building is covered when it meets all of these:

  • Wood frame construction (Type V).
  • The permit for the original construction was applied for before January 1, 1978.
  • Five or more residential units.
  • Two or more stories over a basement or underfloor area with any part above grade.
  • A soft story condition that has not been seismically strengthened to the ordinance’s standards.

The program sorts buildings into four tiers, with ground floor commercial uses and mapped liquefaction zones in their own tier. The Department of Building Inspection’s program database lists each building’s deadlines.

Why it matters after a fire or a water loss: was the retrofit done? When, and under which permit? Those answers shape which code work belongs in the claim. Code work is paid from ordinance or law coverage, up to its own limit. That limit is printed in your policy. We read it before the scope is written, so the code work is priced against money that’s actually there.

Earthquake Damage and Fire After an Earthquake

California’s Department of Insurance puts the first rule plainly: “Your homeowners insurance does not cover earthquake damage.” Earthquake coverage is bought separately. The California Earthquake Authority provides most of it in this state.

Fire is the exception. California law says homeowners and renters insurance must cover fire damage that is caused by or follows an earthquake. That fire is a homeowners claim, even if you never bought earthquake coverage.

After a quake, one building can carry two losses. Shaking damage belongs to the earthquake policy, if there is one. Fire, heat and smoke belong to the homeowners policy. The line between them has to be measured and documented, wall by wall, before the carrier draws it for you.

Your insurer must also offer you earthquake coverage in writing, and repeat the offer every other year.

Fire and Smoke Claims We’ve Settled

Heat Is Fire Damage. Smoke Is Chemistry.

Apartment fire, 800 sq ft, started by a computer. Settled for nearly $200,000, including the tongue and groove ceiling and smoke mitigation for the neighboring unit.

Smoke damage. Offered $17,000. Settled for about $1.1 million. An industrial hygienist proved combustion byproducts in porous materials and doors.

Results reflect specific losses and policies. Past results don’t guarantee a similar outcome.

When You May Not Need Us

On a small loss, our fee may outweigh what we add. If the carrier’s offer is already fair, we’ll tell you so at the free review, before you sign anything.

Questions About Hiring a Public Adjuster in San Francisco

Does homeowners insurance cover earthquake damage in San Francisco?

No. The Department of Insurance says homeowners insurance does not cover earthquake damage, except fire. Earthquake coverage is bought separately, and the California Earthquake Authority provides most of it in California.

Is fire after an earthquake covered?

Yes, under your homeowners or renters policy. California law requires both to cover fire damage caused by or following an earthquake. You don’t need an earthquake policy for that part of the claim.

Does my building fall under the soft story ordinance?

Only if it meets all of the city’s tests: wood frame, a permit for the original construction applied for before January 1, 1978, five or more residential units, two or more stories over a basement or underfloor area, and a soft story that hasn’t been strengthened to the ordinance’s standards. The Department of Building Inspection’s program database lists each building’s deadlines. Bring that record to the free review.

How much does a public adjuster cost in San Francisco?

No upfront cost. We’re paid a percentage of what we recover. The terms are set in writing before we start, and in California our fee can never leave you with less than your insurer had already paid before you hired us. Public adjuster fees, explained

I already have an offer. Is it too late?

Usually not. We can reopen scope before you accept. If you signed a final release, it usually is too late for that claim, so read anything the carrier sends before you sign it.

Will my insurer treat me differently if I hire a public adjuster?

Carriers work with public adjusters every day. The difference is what gets measured. You can still talk to your insurer at any time. Most clients prefer we handle it.

Will hiring a public adjuster slow my claim?

It can. A 2010 Florida state study of claims at Citizens Property Insurance found claims with a public adjuster took longer to settle, and paid more before fees. More of the loss gets measured and argued, and that takes time.
